Baillargeon, 2012 QCCA 1495 (CanLII)"},"content":{"rendered":"<p><strong>Les faits<\/strong>\u00a0: Un cadre de niveau sup\u00e9rieur (l&rsquo;Intim\u00e9) est engag\u00e9 par Transforce. \u00a0<a href=\"http:\/\/canlii.ca\/t\/fsgkp\">D\u00e9cision compl\u00e9te<\/a>.\u00a0 Juste avant d\u2019\u00eatre engag\u00e9 par Transforce, il est suspendu par son employeur ant\u00e9rieur Ratiopharm d\u00fb \u00e0 un courriel anonyme all\u00e9guant un d\u00e9tournement de fonds.\u00a0 Les all\u00e9gations se sont av\u00e9r\u00e9es fausses et la suspension de l\u2019intim\u00e9 a \u00e9t\u00e9 retir\u00e9e.\u00a0 Lors du processus d\u2019embauche avec Transforce, l\u2019intim\u00e9 n\u2019a pas fait allusion aux all\u00e9gations ni \u00e0 la suspension.\u00a0 L\u2019intim\u00e9 quitte son emploi avec Ratiopharm pour se joindre \u00e0 Transforce.\u00a0 Plusieurs moins plus tard, des cadres de Transforce re\u00e7oivent un courriel anonyme similaire concernant l\u2019intim\u00e9 et des all\u00e9gations de d\u00e9tournement de fonds.\u00a0 Malgr\u00e9 une enqu\u00eate par Transforce qui a r\u00e9v\u00e9l\u00e9 la fausset\u00e9 des all\u00e9gations, Transforce cong\u00e9die l\u2019intim\u00e9 pour avoir omis de divulguer les all\u00e9gations et la suspension lors de son embauche. La juge de premi\u00e8re instance a accueilli le recours en dommages-int\u00e9r\u00eats (11 mois de salaire) et ne consid\u00e8re pas l\u2019indemnit\u00e9 pr\u00e9c\u00e9dente accord\u00e9e \u00e0 l\u2019intim\u00e9 par Ratiopharm.<\/p>\n<p><strong>Questions en litige\u00a0 :<\/strong>\u00a0 [1] Une personne en processus d&#8217;embauche est-elle tenue de d\u00e9voiler \u00e0 son futur employeur qu&rsquo;elle est l&rsquo;objet d&rsquo;une enqu\u00eate chez son employeur du moment, enqu\u00eate d\u00e9clench\u00e9e par un courriel anonyme et calomnieux la concernant? [2]\u00a0 La juge de premi\u00e8re instance a-t-elle commis une erreur relativement au d\u00e9lai de cong\u00e9 de onze mois qu&rsquo;elle a accord\u00e9 \u00e0 l&rsquo;intim\u00e9 de m\u00eame qu&rsquo;en refusant de prendre en compte l&rsquo;indemnit\u00e9 de d\u00e9part de 450\u00a0000\u00a0$ que Ratiopharm a pay\u00e9e \u00e0 l&rsquo;intim\u00e9?<\/p>\n<p><strong>D\u00e9cision\u00a0: <\/strong>Aucune divulgation n\u2019\u00e9tait requise.\u00a0 La <em>Charte des droits et libert\u00e9s <\/em>et le<em> Code Civil du Qu\u00e9bec<\/em> garantissent \u00e0 chacun le droit \u00e0 l\u2019int\u00e9grit\u00e9, la dignit\u00e9, l\u2019honneur et la r\u00e9putation.\u00a0 Un candidat \u00e0 un poste ne peut donc \u00eatre tenue de divulguer des all\u00e9gations calomnieuses contre lui, car autrement il est contraint \u00e0 renoncer \u00e0 ses droits fondamentaux et \u00e0 l&rsquo;auto-infliger ce que la loi interdit aux autres de faire. Sur l&rsquo;indemnit\u00e9 de d\u00e9part, le but de l&rsquo;indemnit\u00e9 de d\u00e9part est de permettre \u00e0 l&#8217;employ\u00e9 d&rsquo;avoir un d\u00e9lai raisonnable pour trouver un emploi \u00e9quivalent sans encourir de pertes \u00e9conomiques. Apr\u00e8s \u00e9tude des circonstances, la Cour maintient la d\u00e9cision de 11 mois. Le juge de premi\u00e8re instance a eu raison de ne pas consid\u00e9rer la rupture pr\u00e9c\u00e9dente parce que l&rsquo;appelant ne peut pas se soustraire \u00e0 ses obligations l\u00e9gales en se fondant sur un autre contrat avec un tiers.
