FAMILY LAW

Family law is a branch of civil law that aims to regulate family relations and protect the rights and interests of family members in various legal situations. The Civil Code of Quebec (CCQ) includes therefore a wide range of issues related to family relationships and obligations. A few of these family topics include:

MARRIAGE AND CIVIL UNION

Family law regulates marriage formalities, the rights and obligations of spouses, prenuptial contracts, and rules concerning civil unions.

DIVORCE AND SEPARATION

This part of the CCQ concerns divorce and separation procedures, including the division of property and debts, alimony, child custody, and visitation rights.

CHILD CUSTODY AND VISITATION RIGHTS

Family law establishes the rules regarding custody of children after separation or divorce, parental rights, visitation rights and decisions relating to parental authority.

CHILD AND SPOUSE SUPPORT

The CCQ also provides alimonies to ensure that children and spouses in need of financial support receive appropriate support.

DOMESTIC VIOLENCE AND PROTECTION ORDERS

Family law provides protective measures for victims of domestic violence, such as protection orders and emergency measures. If you are accused, please know that our criminal lawyer will be able to assist you in the legal process.

PARENTAL ALIENATION

In high conflict separations or divorce, parental alienation is sometimes present. Parental alienation is when one parent psychologically manipulates and brainwashes their child into showing unjustified fear, disrespect or hostility towards the other parent. It can result in serious emotional disorders, behavioral problems and depression for the child. Parental alienation must be taken very seriously with decisive legal action and partnering with other experts.

Example of a contested case: Child maintaining close relationship with both parents.

The interest of the child commands a priori that the child have a relationship as close as possible with his two parents. The Court of Appeal maintains the judgement of first instance which granted custody of the 4 year old child to the father because the mother did everything possible to exclude him from the life of the child.
