Between 2021 and 2022, family mediation helped 85% of couples without children and 86% of couples with children reach an agreement on the terms of their separation.  These results highlight what many families already recognize: mediation is an effective, practical, and empowering alternative to court proceedings.

Family mediation offers several key advantages, including:

  • Government-funded sessions through the Quebec Ministry of Justice, making it more affordable;
  • A generally faster and more efficient process than traditional litigation;
  • A collaborative, solution-focused environment rather than a confrontational one.

As separation can be emotionally and financially demanding, mediation provides a structured and supportive framework to help couples move forward with clarity and confidence, without the need to go to court.

How It Works and Why It Matters

Available in Quebec since the 1980s—and expanded to couples without children in 2021, family mediation is a voluntary process led by an accredited mediator.  Neutral and confidential, the mediator helps both parties communicate effectively and work toward fair and balanced solutions tailored to their unique situation.

Rather than leaving decisions in the hands of a judge, mediation empowers couples to remain in control of outcomes that directly affect their lives and their families.  The process encourages respectful dialogue, reduces conflict, and promotes long-term cooperation, especially important when children are involved.

Family mediation can help resolve key issues such as:

  • Parenting time arrangements (custody);
  • Child support and financial contributions;
  • Special expenses (such as childcare or post-secondary education);
  • Division of assets and debts.

Beyond resolving disputes, mediation also helps lay the groundwork for a healthier post-separation dynamic.  Clients benefit from:

While mediation is highly beneficial in most cases, it may not be appropriate in all cases. For example, in certain situations involving domestic violence or certain psychological concerns, court intervention is generally recommended.

Affordable and Accessible

One of the strongest advantages of family mediation is its affordability.  The Quebec Ministry of Justice covers a number of mediation hours for eligible couples, whether married or not.  The number of free hours varies depending on the situation.  For a first agreement in the context of a separation or divorce:

  • For couples without dependent children : 3 free hours
  • For couples with dependent children : 5 free hours

In addition, it is possible in some cases to benefit from an additional 2.5 hours.  For example to:

  • Modify an agreement or review a judgment (e.g., child support may be revised annually through mediation);
  • Resolve another dispute;
  • Obtain a divorce judgment when the parties have already obtained a judgment of separation from bed and board.

To benefit from the free hours of family mediation services, the mediator must be accredited and participate in the Family Mediation Program established by the Quebec Ministry of Justice.  It is therefore important to inquire in advance about the mediator’s fee structure.
